Valid workers' compensation claims get denied regularly. Many times an initial claim is turned down because the paperwork was improperly filled out or because there was no evidence provided that showed the injury occurred while performing a job-related duty. The good news is workers' comp denials can be appealed, and retaining legal counsel can help improve your chances of collecting the benefits to which you are entitled.

At Limonjyan Law Group, our attorneys help workers throughout the greater Los Angeles area with the workers' compensation appeals process. Schedule an initial consultation at our law offices in Burbank by calling 213-640-2693.

The Appeals Process

To appeal a workers' compensation denial, you must complete an "application for adjudication of claim" form. Once this claim has been filed with the local Division of Workers' Compensation (DWC) office, you will be assigned a case number, which will be used for all documents related to your claim.

A hearing will be scheduled before a judge who, after reviewing your claim, will attempt to reach a settlement with the claims administrator. If an attempt at a settlement fails, you may request a trial before a different judge. Because there are so many complex steps to appealing a workers' compensation denial, having a lawyer on your side can help put you in the best position to succeed.
