In theory, the workers’ compensation process should be straightforward. If you suffer an injury at work or while performing a job-related duty, you should receive compensation for any related medical treatments and/or for time spent away from work.

However, valid workers’ compensation claims are denied all of the time. That is why it is important to have skilled legal counsel on your side who can help guide you through the workers’ comp system.

Most, if not all, work environments have inherent risks. You are entitled to compensation benefits if you are involved in a crash while driving a company vehicle, exposed to toxic substances, or suffer injuries at a construction site or a slip and fall accident.

If you have suffered job-related injuries, hiring a workers’ compensation lawyer for legal guidance is in your best interest. At Limonjyan Law Group, our attorneys specialize in employment law and can help you file a worker’s compensation claim.

We Handle All Workers’ Comp Claims

Our attorneys provide representation for all compensation claims, including those involving:

  • Industry-specific claims: We represent people who have been hurt at all types of jobs, including union workers, as well as restaurant workers and caretakers. The truth is workplace injuries can happen anywhere, from construction sites to office settings, and do not have to involve a single accident. Injuries such as repetitive motion injuries and occupational illnesses can take months or years for their symptoms to be known. If your injury can be traced back to your workplace, we can fight to recover the compensation to which you are entitled.
  • Workers’ comp appeals: If your initial claim for workers’ compensation benefits is denied, you still have options. We can gather the necessary information and file the paperwork needed to help make a stronger case on appeal.
  • Permanent disability claims: If medical treatment has done all it can but you still suffer from the effects of a work-related injury, you may be eligible to receive permanent disability benefits. Our attorneys can let you know what to expect and can help you file a claim.

What if a workplace injury develops over time or I contract a work-related illness?

A workplace injury that develops over time and impacts your life, either economically or non-economically, is considered cumulative trauma. For injuries that develop over time or if you contract a workplace-related illness, the statute still remains. However, the date of the injury or illness begins when a disability presents itself, or you become aware it was caused by something work-related. From that point, you have one year to file a workers’ compensation claim.

Is there a time limit for me to file a claim?

The time limit for filing a workers’ compensation claim in California is one year from the time of the accident. However, it is recommended to report your accident or injury within 30 days to allow for quick response and investigations.

What if I file a claim on time, but I’m not notified of its acceptance or approval?

If you file a claim a year after a workplace incident, injury, or illness, your claim will be accepted at the very least within 90 days. If the insurance company fails to act on the claim that you filed, if you have not heard anything or received any confirmation of acceptance, it’s automatically considered accepted after 90 days. After that time, you are entitled to workers’ compensation benefits.

Will my full salary be reimbursed by workers’ compensation?

In most cases, workers’ compensation benefits will not reimburse your entire salary. You will only receive up to two-thirds of your lost wages.

For how long will I remain on workers’ compensation?

On average, workers’ compensation benefits will be provided for 104 weeks or two years after the accident. The 104 weeks of benefits can also be spread out over the course of five years if you don’t want to use the 104 weeks of benefits consecutively.

What’s the average workers’ compensation claim amount?

In California, a worker can get between $2,000 and $100,000. The compensation amount varies depending on injury severity, time off work, and other crucial factors.
